Terms of Service

1. Acceptance

By creating an account or using Forev (“Service”), you agree to these Terms. If you do not agree, do not use the Service. These Terms constitute a binding legal agreement between you and Forev (a Delaware C-Corporation).

2. Eligibility

You must be at least 18 years old and a US resident to use Forev. By using the Service, you represent that you meet these requirements.

3. Your Content

You retain ownership of all memories, voice recordings, and content you submit. By uploading content, you grant Forev a limited license to store, process, and display that content to provide the Service — including AI enrichment and voice model training with your explicit consent.

You are responsible for ensuring you have the right to upload any content. Do not upload content that violates others’ rights or applicable law.

4. Biometric Consent

Voice clone creation requires separate written biometric consent per our Privacy Policy and applicable state law (BIPA). You may revoke consent at any time. Without consent, voice recording is still available for transcription only.

5. Posthumous Access

The Eternal portal feature allows designated family members to interact with your AI persona after your death. This feature activates only after death verification by the executor you designate and a 72-hour contest window. You control access via your Consent Vault settings.

Forev does not independently verify death claims — we rely on the documentation provided by your designated executor. We reserve the right to require additional verification.

6. Prohibited Uses

• Uploading content depicting or promoting abuse, violence, or illegal activity
• Impersonating another person to create their voice clone without consent
• Attempting to access other users’ data
• Automated scraping or abuse of the API
• Using the Eternal portal to harass or deceive family members

7. Subscriptions and Billing

Paid plans are billed monthly or annually via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. No refunds for partial periods unless required by law. We reserve the right to change pricing with 30 days’ notice.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, make changes, or temporarily suspend the Service without notice in urgent cases. We are not liable for losses caused by downtime.

9. Limitation of Liability

To the maximum extent permitted by law, Forev’s liability for any claim arising from the Service is limited to the amount you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.

10. Termination

You may delete your account at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your data will be deleted per our Privacy Policy retention schedule.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
